The short version
- Prices are shown before VAT. The price you see, plus VAT, is the price you pay. Anything extra is agreed with you first.
- You see your work before it's finished and can ask for changes.
- Once it's paid for, it's yours: your website, your logo, your domain.
- Care plans can be cancelled anytime with no fees. SEO and Google Ads have a 3-month minimum.
About these terms
These terms apply when you buy from ATK (Auction Template King), whether through our website, by accepting a quote or by signing up to a monthly plan. "We" and "us" means:
Auction Template King is a trading name of Saint Nicolas Ltd. Registered in England and Wales, company no. 07975304. VAT no. GB 328 6276 79. Registered office: Nuneaton, Warwickshire, CV11 6JF.
"You" means the person or business placing the order. Please read these terms before you buy. By placing an order, you agree to them.
Most of our clients are businesses. If you're buying as a private individual, for something not connected to a business, you're a consumer and you have extra legal rights. Where these terms treat consumers differently, we say so. Nothing in these terms affects your legal rights as a consumer.
For bespoke projects, such as bespoke CMS builds and web apps, we'll also send a written quote. If the quote and these terms disagree, the quote wins.
Prices and payment
- All prices are in pounds sterling and exclude VAT. VAT is added at the current rate (20%) and shown before you pay, at checkout and on your invoice. Our VAT number is GB 328 6276 79.
- Packages are paid in full when you order, through PayPal by debit or credit card or with a PayPal account.
- Payments are made to Saint Nicolas Ltd, the company that trades as Auction Template King, so that's the name you'll see in PayPal and on your statement.
- Monthly plans are paid monthly in advance as a PayPal subscription, starting on the day you sign up.
- Quoted projects are paid in the stages set out in your quote. Usually that's a deposit to start and the balance before the work goes live.
- If a monthly payment fails, we'll let you know and try again. If it's still unpaid after 14 days, we may pause the plan until it's paid.
We check our prices carefully, but if we've made an obvious mistake, we'll contact you before starting work. You can then pay the correct price or cancel for a full refund.
Your brief and content
After you order, we'll ask you to fill in a short brief and send any content we need, such as your logo, words and photos. We'll start once we have it.
- You're responsible for making sure anything you send us is accurate and that you have the right to use it. That includes photos, logos, text and product information.
- Please don't send anything unlawful, or anything that belongs to someone else without their permission. We can refuse to use content we think breaks the law.
- If we haven't heard from you for 60 days while we're waiting for content or feedback, we may close the project. We'll warn you first. Work done so far is still payable, and we'll happily pick it up again when you're ready.
Timescales
Each service page shows how long the work usually takes, such as a website live in 7 working days. Timescales start once we have your brief and content, and they assume you reply to us within a couple of working days.
We work hard to meet them, but they're estimates, not guarantees. If something outside our control delays your project, we'll tell you as soon as we know.
Changes and approval
- We'll show you your work, on a preview link or as proofs, before it's finished. Each package includes the rounds of changes listed on its service page.
- Changes mean adjustments to the agreed design. Brand new ideas or extra pages after the design has been agreed are new work, and we'll give you a fixed price before doing them.
- When you're happy, you approve the work and we publish it or send you the final files.
- Please check proofs carefully. Once you've approved print designs, we can't be responsible for spelling mistakes or wrong details that were in the approved proof, or for the cost of reprinting.
Who owns the work
- Once you've paid in full, you own the final designs we make for you. The copyright passes to you, so you can use them anywhere and trade mark them if you want to.
- Your domain name is registered in your name. Google Ads and similar accounts we set up for you are in your name too.
- Some things we use belong to other companies, such as stock photos, fonts, WordPress themes and plugins. You get the right to use them as part of your project, under their own licence terms, but you don't own them.
- We keep the tools, code and methods we use across all our projects. You're free to use them as part of your website, but you can't resell them separately.
- We may show finished work in our portfolio and on social media. If you'd rather we didn't, just tell us.
Monthly plans
Website maintenance, website management and monthly social media posts
- There's no minimum term. You can cancel anytime with no fees, by emailing us or by cancelling the subscription in your PayPal account. The plan ends at the end of the month you've already paid for.
- If you leave a hosting plan, we'll send you your website files and a full backup so you can host it elsewhere.
- Work included in a plan doesn't roll over to the next month if it isn't used.
SEO and Google Ads
- These have a minimum term of 3 months, because it takes that long to see results. After that, you can cancel anytime with one month's notice.
- Your Google Ads budget is paid directly to Google, separately from our management fee.
- Everything we build for you, such as pages, listings and ad accounts, stays yours if you leave.
If we change a plan's price, we'll give you at least 30 days' notice by email, so you can cancel before it applies.
Third-party costs
Our prices cover our own work. Unless your package or plan says otherwise, these are paid separately:
- Domain name renewals, after any first year included in your package
- Hosting, if you're not on one of our care plans
- Printing. Our prices cover design and print-ready files. We're happy to recommend a printer.
- Paid plugins, apps or platform fees, such as a Shopify plan
- Advertising spend, such as Google Ads
- Card fees charged by your own payment provider on your sales
We'll always tell you about these before you commit.
Cancelling an order
If you're a business
You can cancel before we start work for a full refund. After we've started, you'll pay for the work done so far, and we'll refund the rest.
If you're a consumer
You have 14 days from the day you order to cancel for any reason. If you ask us to start work within those 14 days and then cancel, we'll deduct a fair amount for the work already done. Once the work is finished and delivered within the 14 days, you can no longer cancel.
To cancel, email hello@auctiontemplateking.com with your order number. We'll refund you within 14 days, using the same payment method you used to pay.
If you're not happy
Tell us as soon as you can. Most problems are fixed quickly with another round of changes. If we still can't agree after that, we'll refund you for any part of the work you haven't received.
If something we've built stops working because of a fault in our work, we'll fix it free of charge within 30 days of going live. After that, fixes are covered by a care plan or charged at a fixed price we agree with you first.
What we can't promise
- Search rankings and ad results. Google decides where sites appear and how ads perform. We'll do the work we agree and report on it honestly, but we can't guarantee positions, clicks or sales.
- Marketplace approval. eBay and Amazon review content against their own rules, which can change. We design to their current rules and will make reasonable changes if something is rejected.
- Uptime. We aim to keep hosted websites online at all times, but outages can happen. We'll work to restore service as quickly as we can.
- Third-party services. We're not responsible for changes or failures of services we don't control, such as payment providers, plugins or social media platforms.
Our responsibility to you
We'll do our work with reasonable care and skill. If we don't, and you lose out as a result, we're responsible for losses that were a foreseeable result of what went wrong.
For business customers: our total responsibility for any order is limited to the amount you paid for it, or for monthly plans, the amount paid in the 12 months before the problem. We're not responsible for lost profits, lost sales, lost data or other indirect losses. Please keep your own copies of important content.
For consumers: we're not responsible for losses that weren't foreseeable, or for business losses.
Nothing in these terms limits our responsibility for death or personal injury caused by our negligence, for fraud, or for anything else the law doesn't allow us to limit.
Everything else
- Changes to these terms. We may update these terms from time to time. The version on this page when you order is the one that applies to that order.
- Confidentiality. We keep your business information private and only share it as described in our Privacy Policy.
- Events outside our control. We're not responsible for delays caused by things we can't reasonably control, such as a major internet outage.
- Transfer. We may pass our rights and duties under these terms to another business, and we'll tell you if we do. You'll need our agreement to pass yours to someone else.
- If part of these terms isn't valid, the rest still applies.
- Law. These terms are governed by the law of England and Wales. If you're a consumer living in Scotland or Northern Ireland, you can also bring a claim in your local courts.
